What If?
If the application is opposed, it may be on the grounds of inadequate service of invitations to tenants to become members or improper service of the claims notice or perhaps a challenge to the qualifying status of the building or tenants. The implications are time and cost.
The time factor is in re-serving documents and/or waiting for a hearing date at the LVT and the main cost is of defending the LVT proceedings. However, it may not be necessary to involve solicitors or barristers in those proceedings which are less formal than those of the County Court.
